 If you are buying a property in Ahmedabad, remember that payment of stamp duty and registration charges to the government is an integral part of the procedure which helps protect your property against future disputes.

Ahmedabad, the sixth largest city in India, is often considered one of the most business-friendly cities. In 2010, it was ranked third in the list of the fastest growing cities of the decade by Forbes. With a steady rate of economic development in the city and attractive schemes being marketed by developers, more and more people are looking towards Ahmedabad as a lucrative real estate investment. While purchasing properties in the city, it becomes imperative to keep in mind the various legal guidelines that govern the property market. One such important consideration is the stamp duty and registration charges that are levied while registering a property.

Stamp duty is the tax that the buyer of a property must pay to the state government on any property transaction while registration fee is paid for the maintenance of ownership records. These charges help lend authenticity to the property documents and safeguard the owner’s interest in case of any future dispute or fraud. Stamp duty charges vary from one state to another and may depend on gender, municipal areas or income groups within the state too.

In Ahmedabad, stamp duty is charged at 4.9 percent and registration fee is one percent of the market price of the property or the transaction value, whichever is higher. Currently, female property owners are exempted from the registration fee. This waiver of registration fee for females is aimed at empowering women and motivating more families to register properties in the name of female family members. Apart from these charges, an additional service tax of 3.50 percent also has to be paid for under construction properties worth less than Rs one crore and 4.2 percent for properties worth more than Rs one crore.

To understand the calculation better, let us assume that two adjacent properties in Ahmedabad of similar value, say Rs 10 lakh, are bought by a man, Suraj and Ritu, a woman. Following will be the total cost of the property for them:

Stamp duty payable by Suraj = 10,00,000 * 4.9/100 = Rs 49,000

Registration fee = 10,00,000 * 1/100 = Rs 10,000

Service tax = 10,00,000 * 3.5/100 = Rs 35,000

Hence, total cost of the property for Suraj = Rs 10,00,000 + Rs 49,000 + Rs 10,000 + Rs 35,000= Rs 10,94,000

 

Stamp duty payable by Ritu = 10,00,000 * 4.9/100 = Rs 49,000

Being a woman, Ritu is exempt from the payment of registration fee.

Service tax = 10,00,000 * 3.5/100 = Rs 35,000

Hence, total cost of the property for Ritu = Rs 10,00,000 + Rs 49,000 + Rs 35,000 = Rs 10,84,000

      Male owners have to have 4.9 percent of stamp duty and one percent registration fee in Ahmedabad, however in case of female owners there has an exemption in case of registration fees.

      Besides, the tax clarification could be provided only if you disclose the construction status of the property.

      The rebate on registration fees is available for only women homebuyers. In case of a jointly purchased property, you cannot avail the exemptions. However, you can claim tax benefit on your income.

      The registration charges remain the same for all houses, new or old. In your case, you shall be charged one percent of the total deal value as registration cost. In addition, you will be levied a stamp duty of 4.9 percent.
